RETURNS AND COMPLAINTS
-
WITHDRAWAL FROM THE CONTRACT – RETURN OF GOODS
-
In accordance with the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2024, item 1796, as amended), a Consumer who has concluded a distance contract through the online store www.4japancars.com has the right to withdraw from the contract without giving any reason within 14 days from the date on which the Consumer or a person indicated by the Consumer other than the carrier took possession of the goods.
-
In the case of a contract covering several goods that are delivered separately, in batches or in parts, the 14-day period begins on the day on which the Consumer takes possession of the last good, batch or part.
-
In order to exercise the right of withdrawal, the Consumer must inform the Seller of their decision before the expiry of the 14-day period by submitting an unequivocal statement of withdrawal from the contract. The statement may be submitted in writing or electronically.
-
The Consumer may use the withdrawal form provided by the Seller, but its use is not mandatory. To meet the deadline, it is sufficient to send the withdrawal statement before the expiry of the 14-day period. The withdrawal form is available on the Contact page.
-
After withdrawing from the contract, the Consumer is obliged to return the goods to the Seller without undue delay and no later than 14 days from the date on which the Consumer informed the Seller of the withdrawal. The deadline is met if the goods are sent back before the expiry of this period.
-
The direct costs of returning the goods shall be borne by the Consumer, unless the Seller has agreed to bear them or has failed to inform the Consumer of the obligation to bear these costs.
-
The goods should be properly secured for transport in order to minimise the risk of damage.
-
The Consumer is not required to return the goods in their original packaging. The lack of original packaging may not constitute a condition for accepting the return.
-
The Consumer may return the goods even if they have used them beyond what is necessary to establish their nature, characteristics and functioning. However, if the Consumer has used the goods beyond what is necessary to establish their nature, characteristics and functioning, they may be liable for any reduction in the value of the goods in accordance with the applicable provisions of law.
-
The Seller shall reimburse the Consumer for all payments made by the Consumer, including the cost of delivery of the goods to the Consumer, subject to the provisions of the applicable law. If the Consumer has chosen a delivery method other than the cheapest standard delivery method available in the store, the Seller is not obliged to reimburse the additional costs resulting from the choice of a more expensive delivery method.
-
Refunds shall be made using the same method of payment used by the Consumer, unless the Consumer has expressly agreed to another solution.
-
The Seller may withhold the refund until the returned goods have been received or until the Consumer provides proof of returning the goods, whichever occurs first.
-
The right of withdrawal does not apply to Consumers in the cases specified in Article 38 of the Act of 30 May 2014 on Consumer Rights, in particular with regard to contracts concerning non-prefabricated goods manufactured according to the Consumer's specifications or serving to meet their individual needs, where the circumstances specified by law apply.
-
COMPLAINTS – NON-CONFORMITY OF GOODS WITH THE CONTRACT
-
All goods offered in the store www.4japancars.com are brand new, except for products explicitly marked as used in the product description.
-
The Consumer has the right to submit a complaint if the purchased goods are not in conformity with the contract, in accordance with the principles set out in the Act of 30 May 2014 on Consumer Rights.
-
The Seller is liable for any lack of conformity of the goods with the contract in accordance with the terms and for the period specified in the applicable provisions of law.
-
If the goods are found not to be in conformity with the contract, the Consumer may first request that the goods be repaired or replaced. The Seller may replace the goods instead of repairing them, or repair them instead of replacing them, if the method chosen by the Consumer is impossible or would require excessive costs.
-
If the lack of conformity of the goods with the contract is significant, the Consumer may request a reduction in price or withdraw from the contract, in accordance with the applicable provisions of law.
-
A complaint may be submitted in any form that allows its contents to be communicated to the Seller. To facilitate the processing of the complaint, it is recommended that the complaint include the order number, the name or part number, a description of the identified non-conformity and the Consumer's request.
-
In order to process a complaint, the Seller may request that the complained-about goods be delivered. The method and place of delivery will be agreed with the Consumer.
-
The Consumer is not required to provide the original packaging of the goods as a condition for processing the complaint.
-
In the case of a complaint concerning non-conformity of the goods with the contract, the costs associated with bringing the goods into conformity with the contract, including transportation costs, shall be borne by the Seller in accordance with the applicable provisions of law.
-
The Seller shall respond to the Consumer's complaint within 14 days from the date of receipt. If the Seller does not respond within this period, the complaint and the Consumer's request shall be deemed justified to the extent provided for by law.
-
If the complaint is accepted, the Seller shall bring the goods into conformity with the contract by repairing or replacing them, in accordance with the Consumer's request and the applicable provisions of law.
-
If, in accordance with the applicable provisions of law, the Consumer is entitled to a price reduction or withdrawal from the contract, the Seller shall make the appropriate refund or price reduction in accordance with the Act of 30 May 2014 on Consumer Rights.
-
The provisions of these Terms and Conditions do not limit the Consumer's rights arising from mandatory provisions of law.
-
DAMAGE TO THE SHIPMENT DURING TRANSPORT
-
If visible damage to the shipment is discovered upon delivery, it is recommended, where possible, to inspect the condition of the shipment in the presence of the carrier and prepare a damage report.
-
Failure to prepare a damage report upon delivery does not deprive the Consumer of the right to submit a complaint concerning non-conformity of the goods with the contract or any other rights granted under applicable law.
-
If damage to the goods is discovered after unpacking, the Seller should be contacted and information enabling the claim to be processed should be provided.
-
WARRANTY
-
If a warranty has been granted for a particular product, the rights arising from the warranty are independent of the Consumer's rights arising from non-conformity of the goods with the contract.
-
The detailed warranty conditions are specified in the warranty statement issued by the manufacturer or warrantor. Exercising warranty rights does not limit the Consumer's rights arising from the provisions concerning non-conformity of the goods with the contract.
-
In matters not regulated in this section, the provisions of the Act of 30 May 2014 on Consumer Rights and other applicable provisions of Polish law shall apply.
